Mr. Polito called the meeting to order at 7:45P.M.

Public Hearing – Continued from December 12, 2007 - 8:00 P.M.
William Norton for Paul Forkus, Jr., request for Special Exception Permit as specified in Zoning Ordinance Article IV, Section 460 to allow construction of a 22x24 addition to include an Accessory Living Unit (for Paul Forkus, Sr.) to existing dwelling located at 108 Maple Avenue, Map 14, Lot 21, TR2 Zone.
Abutters list was read with the following present Bill Norton for Paul Forkus, Jr.
The Board reviewed the minutes from the last hearing. The Board agreed that based on the prior discussion, criteria A through E had been met. The Board reviewed the rest of the criteria.
F. – Based on Figure 1 on the plans and based on the verbal description, the addition is to the rear of the house and is not visible from the front. The appearance is that of a single family residence. The Board agreed this criterion was met.
G. – There is direct access through the living room. The Board discussed that the living room was listed as common area. The Board agreed they would feel more comfortable listing the living room as part of the accessory unit. The square footage including the living room was 752 square feet, but that included stairwells and other common areas. The floor plan depicts direct access. The plan is outlined in yellow and includes egress. There is direct access from the interior of the house. The Board agreed the living room would be included in the accessory unit. The Board agreed this criterion was met.
H. – There is a State approved Septic Plan. The Board agreed this criterion was met.
The Board agreed that an exterior door to the side or the rear of the accessory unit would be allowed and gave the builder the option of adding a door. The Board also told the applicant that the basement couldn’t be finished to be used for space for the accessory unit.
Motion to approve the request for an accessory unit was made by Mr. Friel, based on plans and drawings submitted January 9, 2008 and that all conditions have been met, except for A, C, D, I and K, which will be met before the issuance of an occupancy permit. This approval expires one year from today if not acted upon. Mr. Riehl seconded and the motion was unanimously approved.

Motion to adjourn was made and seconded. Mr. Polito adjourned the hearing at 8:15 P.M.
